This page contains the Terms & Conditions, cancellation and refund rules, FLEX 75 terms, promotional travel requirements, supplier disclosures and other policies governing reservations and travel experiences purchased through Departure Depot.
Your Agreement With Departure Depot
These Legal, Booking Terms & Travel Policies (“Terms”) govern reservations, purchases, payments, communications and participation in travel experiences offered by Elevation Travel Partners, LLC d/b/a Departure Depot (“Departure Depot,” “Company,” “we,” “our,” or “us”).
By completing a reservation, submitting payment, accepting a booking confirmation or participating in a Departure Depot experience, you acknowledge and agree to these Terms together with the trip-specific pricing, disclosures, requirements and supplier conditions applicable to your reservation.
Booking Agreement
Your complete agreement with Departure Depot may include:
- These Legal, Booking Terms & Travel Policies;
- The applicable trip or product page;
- The rate or package selected;
- Checkout disclosures and acknowledgments;
- Your booking confirmation;
- Applicable FLEX 75 terms;
- Applicable Resort Preview or Cruise Preview terms;
- Supplier terms applicable to components of your trip; and
- Written trip-specific amendments communicated by Departure Depot.
If a trip-specific provision differs from a general provision contained on this page, the trip-specific provision generally controls for that reservation to the extent permitted by law.
Our Role
Departure Depot curates, organizes, packages and markets travel experiences using services supplied by independent third parties.
Depending upon the experience, we may coordinate accommodations, transportation, cruises, dining, event admission, hospitality, activities, transfers and other travel components.
Departure Depot may also provide trip hosts, ambassadors, communications and logistical coordination.
Unless expressly stated otherwise, Departure Depot does not own or operate the hotels, resorts, cruise ships, aircraft, motorcoaches, automobiles, event venues, restaurants or other underlying travel services.
Independent Third-Party Suppliers
Travel components may be provided by independent suppliers, including:
- Hotels and resorts;
- Vacation ownership resorts;
- Cruise lines;
- Airlines;
- Motorcoach companies;
- Car, shuttle and rideshare providers;
- Event venues and promoters;
- Ticketing providers;
- Restaurants and caterers;
- Tour and activity operators; and
- Other travel and hospitality businesses.
These suppliers are separate businesses and are not employees, agents or controlled subsidiaries of Departure Depot merely because their services are included in a Departure Depot package.
Suppliers may maintain their own terms, cancellation policies, operating procedures, schedules and conditions of service.
Pricing, Deposits & Payments
Pricing is based upon the package, occupancy, promotional program and rate selected at booking.
Unless expressly stated otherwise, prices described as “per person” apply separately to each traveler and may require specified occupancy.
Departure Depot frequently makes advance financial commitments for accommodations, tickets, cruises, transportation and other components. Payments may therefore become partially or entirely non-refundable after applicable cancellation periods expire.
Payment toward a reservation constitutes acceptance of the applicable booking terms.
Failure to make a required payment when due may result in cancellation and application of supplier penalties or other charges permitted under the booking agreement.
Errors, Omissions & Pricing Corrections
Departure Depot makes reasonable efforts to ensure that website information, advertisements, itineraries, prices and promotional materials are accurate.
Typographical errors, technical errors, incorrect prices, incorrect dates, inventory errors or other inadvertent mistakes may occasionally occur.
Departure Depot reserves the right to correct an obvious error or omission and, when appropriate, offer the traveler the corrected reservation terms or an opportunity to cancel the affected reservation.
FLEX 75
FLEX 75 is Departure Depot's contractual cancellation benefit available with eligible reservations.
When FLEX 75 applies, an eligible traveler who submits a qualifying cancellation request at least 72 hours before the scheduled trip departure may receive 75% of eligible prepaid amounts, subject to the terms and exclusions applicable to the reservation.
Amounts That May Be Excluded
- Concert, sporting-event and attraction tickets;
- Airfare and airline penalties;
- Cruise fares and cruise-line penalties;
- Non-refundable supplier charges;
- Processing or administrative fees;
- The cost of FLEX 75 itself; and
- Other exclusions specifically disclosed for the trip.
The FLEX 75 disclosure associated with the specific reservation controls the calculation of eligible amounts.
Traveler-Initiated Cancellations
Cancellation requests must be submitted through Departure Depot's official online Cancellation Request Form.
Telephone calls, voicemail, text messages, social-media messages or informal emails do not by themselves constitute a completed cancellation request unless Departure Depot expressly confirms cancellation in writing.
The effective cancellation date is the date on which Departure Depot receives a properly completed cancellation request.
FLEX 75 Cancellations
Unless the applicable booking provides otherwise, a cancellation seeking FLEX 75 benefits must be received at least 72 hours before the scheduled trip departure.
Refunds, Reimbursements & Travel Credits
Submission of a cancellation request does not automatically establish entitlement to a refund, reimbursement or travel credit.
Eligibility is determined according to the applicable booking agreement, supplier penalties, excluded components, FLEX 75 benefits if applicable and applicable law.
Approved monetary refunds will generally be returned to the original payment method when practicable.
Processing may require reconciliation with suppliers and payment processors and therefore may take several weeks.
Travel credits may be subject to expiration dates, transfer restrictions, blackout dates or other terms communicated when the credit is issued.
Resort Preview Getaways
Departure Depot may offer specially priced Resort Preview Getaways made possible through relationships with resort and travel-program partners.
Travelers selecting a Preview Rate receive promotional pricing in exchange for satisfying the eligibility and participation requirements disclosed for that particular getaway.
Participation Requirement
Travelers whose participation is required must arrive at the scheduled time and complete the resort preview experience specified for the applicable trip.
Session length, qualification requirements, participating guests and scheduling may vary by destination, resort partner and offer.
No purchase is required to complete a resort preview. Travelers are not required to purchase vacation ownership, membership or another product merely because they participate in the preview.
Qualification requirements may vary by resort partner and may include household, age, income, geographic or other lawful promotional criteria disclosed in connection with the offer.
Where available, travelers who do not wish to participate in a resort preview may select the applicable Full Flexible, Full Experience or retail-rate option.
Failure to Complete a Required Resort Preview
Promotional Preview Rates are conditioned upon completion of the applicable preview requirements.
If required travelers voluntarily decline, fail to attend, leave before completion, or otherwise fail to satisfy the applicable participation requirement, the reservation may become subject to the rate adjustment, decline fee, retail-rate difference or other amount disclosed for that specific booking.
A traveler is never required to purchase the product being presented. The requirement is to satisfy the attendance and participation terms applicable to the promotional rate.
Cruise Preview Programs
Departure Depot may offer promotional cruise pricing associated with a future Resort Preview Getaway commitment.
The applicable cruise offer will disclose the required completion period, eligibility requirements, promotional credit, rate adjustment and other conditions.
Travelers selecting a Cruise Preview Rate agree to fulfill the program requirements associated with that rate.
If the program includes a future Resort Preview Getaway credit, the credit is promotional, has no cash value unless expressly stated otherwise, and is subject to the conditions disclosed with the offer.
Failure to satisfy a Cruise Preview Rate requirement may result in adjustment to the applicable Full Flexible rate or other consequence expressly disclosed and accepted at booking.
Concerts, Sporting Events & Ticketed Experiences
Event promoters and venues control event dates, start times, admission, seating configurations, security procedures, hospitality, food and beverage offerings and other event operations.
Event tickets are generally non-refundable once Departure Depot purchases, commits to or allocates the ticket on behalf of a traveler, except where otherwise stated or required by law.
Exact suite, section, seating or hospitality arrangements may change because of venue or supplier requirements.
When reasonably practicable, Departure Depot will attempt to provide a comparable substitute if an included ticketed component must be changed.
Cruise Travel
Cruise reservations are subject to the applicable cruise line's passenger contract, cancellation policies and onboard rules.
Cruise lines control ports of call, itinerary, arrival and departure times, boarding requirements, onboard operations, documentation requirements and health and safety procedures.
Cruise lines may change or eliminate ports of call without Departure Depot's approval.
Travelers are responsible for satisfying the cruise line's identification, passport, visa and boarding requirements.
Transportation
Transportation included with a Departure Depot experience may be provided by independently owned and operated motorcoach companies, airlines, shuttle companies, rideshare companies, cruise lines, taxi services or other licensed transportation providers.
Departure Depot may arrange, purchase, coordinate or include transportation as part of a travel package, but Departure Depot does not operate the transportation provider's vehicle, employ its driver, maintain its equipment or control the provider's day-to-day transportation operations.
Transportation schedules may change because of traffic, weather, mechanical problems, road closures, government action, venue operations, safety concerns, driver-hour requirements or other circumstances.
Pickup and drop-off locations may also be changed when necessary for safety, traffic management, venue requirements or operational reasons.
Independent Transportation Providers & Allocation of Liability
Important Transportation Disclosure
By purchasing or participating in a Departure Depot experience that includes transportation, the traveler acknowledges and agrees that the actual transportation service is performed by an independent third-party transportation provider unless Departure Depot expressly states otherwise.
The transportation provider is responsible for the operation, maintenance and safety of its vehicles and equipment; the qualifications, licensing, supervision and conduct of its drivers and personnel; and compliance with laws and regulations applicable to its transportation operations.
To the fullest extent permitted by applicable law, Departure Depot is not responsible or liable for the independent transportation provider's acts, omissions, negligence, equipment condition, mechanical failure, driving decisions, accidents, delays, route selection, regulatory compliance or other matters within the transportation provider's operational responsibility or control.
The traveler expressly acknowledges that arranging or including transportation in a Departure Depot package does not make Departure Depot the carrier, vehicle operator or employer of the transportation provider or its personnel.
Claims arising from the actual operation of a third-party transportation service should be directed to the responsible transportation provider and/or its insurer as appropriate.
Departure Depot may assist travelers with identifying or communicating with the applicable provider following an incident, but such assistance does not constitute an admission or assumption of liability.
Nothing in this section is intended to disclaim responsibility for Departure Depot's own conduct where such responsibility cannot lawfully be waived or limited.
Air Travel & Airfare Credits
Unless expressly included as ticketed airfare, travelers are responsible for arranging their own flights.
Airfare credits offered with certain packages are promotional benefits and do not mean Departure Depot operates, controls or guarantees the airline service.
Airlines control flight schedules, cancellations, delays, baggage, seating, boarding and other airline operations.
Travelers should allow sufficient time for airline disruptions when independently arranging transportation to a Departure Depot experience.
Hotels, Resorts & Accommodations
Accommodation type, occupancy and general property information will be described with the applicable trip.
Actual room or condominium layouts, furnishings, views, bedding, décor and configurations may vary.
This is particularly true at resort and condominium properties where individual units may be separately owned or furnished.
Unless specifically included, daily housekeeping should not be assumed.
Guests should promptly report accommodation concerns to the property's front desk and Departure Depot so that the supplier has an opportunity to address the issue during the stay.
Itinerary Changes
Departure Depot itineraries are subject to reasonable change.
Departure Depot may modify timing, activities, transportation, accommodations, dining, ticket distribution, event procedures or other logistical arrangements when circumstances require.
Departure and return times are estimates unless specifically guaranteed in writing.
When a material included component becomes unavailable, Departure Depot may provide a reasonably comparable substitute when practicable.
Minor schedule or itinerary adjustments do not constitute cancellation of the travel package.
Dining, Food & Beverage
Included dining and hospitality may be provided by independent restaurants, caterers, venues, hotels, resorts or other suppliers.
Menus and food-and-beverage offerings may change based upon availability or supplier operations.
Travelers with allergies or dietary restrictions are responsible for communicating those requirements directly to the applicable food-service provider when necessary.
Promotional Credits, Gift Cards & Offers
Departure Depot may provide airfare credits, rideshare credits, future travel credits, gift cards or other promotional benefits.
Promotional benefits may be subject to eligibility requirements, expiration dates, redemption rules and other restrictions.
Unless expressly stated otherwise, promotional credits have no cash value, are not redeemable for cash and are not refundable after cancellation.
Promotional offers may not be combined unless specifically authorized.
Traveler Responsibilities
Travelers are responsible for reviewing trip requirements and determining whether an experience is appropriate for their individual circumstances.
Travelers are also responsible for:
- Providing accurate booking information;
- Reviewing confirmations and trip communications;
- Arriving at designated locations on time;
- Following venue and supplier requirements;
- Maintaining required identification and travel documents;
- Safeguarding personal belongings; and
- Communicating problems promptly during travel.
Identification & Travel Documents
Travelers are responsible for possessing valid identification, passports, visas, travel authorizations and other documentation required for their itinerary.
Names provided during booking should match required travel documents.
Departure Depot is not responsible for denied boarding or denied entry caused by a traveler's failure to satisfy government or supplier documentation requirements.
Mobility, Accessibility & Personal Assistance
Travel may involve walking, standing, stairs, uneven surfaces, crowds, outdoor conditions and boarding various forms of transportation.
Travelers should review the anticipated itinerary and contact Departure Depot before booking if they have questions regarding accessibility.
Departure Depot will communicate accessibility requests to suppliers when appropriate but cannot guarantee that every independent supplier, venue or destination can satisfy every request.
Departure Depot hosts and ambassadors are not personal mobility attendants or caregivers.
Medical Care & Emergencies
Departure Depot does not provide medical care or medical advice.
Travelers are responsible for their personal health needs, medications and medical arrangements.
In an emergency, Departure Depot personnel may contact emergency services or assist in communicating with suppliers, but medical decisions and services are provided by independent medical professionals.
Travelers are encouraged to consider appropriate medical and travel insurance for their individual circumstances.
Guest Conduct
Travelers must behave respectfully toward fellow guests, Departure Depot personnel, suppliers and members of the public.
Departure Depot may restrict or terminate participation when a traveler's behavior is unsafe, threatening, abusive, unlawful, materially disruptive or violates supplier or venue requirements.
Travelers removed because of their conduct may be responsible for resulting expenses and may not be eligible for reimbursement for unused services, subject to applicable law.
Personal Property
Travelers are responsible for safeguarding luggage, identification, electronics, medications, valuables and other personal property.
Departure Depot is not responsible for property lost, stolen, forgotten or damaged while in the custody or control of a hotel, resort, transportation provider, cruise line, venue or other independent supplier, except to the extent applicable law provides otherwise.
Force Majeure & Events Beyond Our Control
Travel may be disrupted by circumstances beyond Departure Depot's reasonable control, including:
- Severe weather and natural disasters;
- Government action or restrictions;
- Public-health emergencies;
- Labor disputes;
- Road, airport or port closures;
- Security incidents;
- Transportation interruptions;
- Supplier shutdowns;
- Event or venue decisions; and
- Other comparable circumstances beyond reasonable control.
Remedies in such circumstances may depend upon supplier policies, amounts recoverable from suppliers and applicable law.
Departure Depot may provide substitute arrangements, rescheduling, travel credit, refund of recoverable amounts or another appropriate remedy depending upon the circumstances.
Problems During Travel & Service Recovery
Travelers should report problems to the responsible supplier and Departure Depot as soon as reasonably possible.
Prompt notification gives the supplier and Departure Depot an opportunity to address the problem while the traveler is still on the trip.
Depending upon the circumstances, Departure Depot may offer a replacement service, travel credit, partial adjustment or another service-recovery remedy.
A goodwill adjustment or exception in one circumstance does not amend these Terms or create an entitlement in another case.
Email, Text & Trip Communications
Departure Depot may communicate with travelers by email, telephone and text message regarding reservations, payments, itinerary updates, operational information and customer service.
Travelers are responsible for providing accurate contact information and monitoring trip-related communications.
Marketing communications are subject to applicable consent and opt-out requirements.
Privacy and data practices are addressed separately in the Departure Depot Privacy Policy.
Website Use
Departure Depot website content is provided for legitimate personal and commercial interaction with Departure Depot.
Website text, branding, graphics, photographs, layouts and other content owned by Departure Depot may not be reproduced or used commercially without permission except as permitted by law.
Users may not interfere with website operations, attempt unauthorized access, submit fraudulent reservations or misuse Departure Depot systems.
Chargebacks & Payment Disputes
Travelers should contact Departure Depot promptly regarding billing concerns so that we have an opportunity to investigate and attempt resolution.
Initiating a chargeback or payment dispute does not itself cancel a reservation or supersede cancellation terms, supplier penalties or other obligations accepted at booking.
Departure Depot reserves all rights and remedies available under applicable law concerning improper or fraudulent payment disputes.
Limitation of Liability
To the fullest extent permitted by applicable law, Departure Depot is not responsible for acts, omissions, negligence or operational decisions of independent third-party suppliers that are outside Departure Depot's reasonable control.
This includes, as applicable, hotels, resorts, cruise lines, airlines, transportation providers, venues, restaurants, activity providers and other independent suppliers.
Departure Depot's inclusion, arrangement or coordination of a third-party service does not by itself make Departure Depot the owner, operator or employer of that supplier.
Nothing in these Terms is intended to waive or limit a consumer right, statutory protection or legal remedy that cannot lawfully be waived or limited.
Responsibility for Traveler-Caused Losses
Travelers are responsible for losses, damages, penalties or expenses resulting from their own unlawful conduct, intentional misconduct, material violation of supplier rules or damage to property, to the extent permitted by applicable law.
Questions, Complaints & Dispute Resolution
Travelers are encouraged to contact Departure Depot promptly regarding a concern or dispute so the parties have a reasonable opportunity to resolve the matter informally.
Additional mediation, arbitration, jurisdiction or dispute-resolution requirements may apply when expressly disclosed in connection with a reservation and enforceable under applicable law.
Governing Law
These Terms and Departure Depot bookings are subject to applicable federal, state and local law.
Any specific governing-law, jurisdiction, venue or dispute-resolution provision applicable to a reservation will be interpreted and enforced only to the extent permitted by applicable law.
Severability & Entire Agreement
If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
These Terms, together with the applicable trip-specific documents and supplier conditions described above, constitute the agreement applicable to the reservation and supersede inconsistent general website descriptions regarding that reservation.
Changes to These Terms
Departure Depot may update these Terms periodically to reflect changes in Company operations, travel programs, supplier relationships or legal requirements.
Material changes will apply prospectively except where applicable law permits otherwise.
The terms applicable to an existing reservation will be determined by the booking agreement and disclosures associated with that reservation.
